Can my business have the same name as another business?

Im opening up a cake shop in Kentucky, and there aren't any businesses in KY with the same name, but there is in California. And its another cake shop. Will that present a problem? Its near impossible to choose a name that no one else is using already.....? How does the law work with copyrights and trademarks and stuff?
